Robert C. Nichols, 23, of Ossining, is facing a charge of driving while intoxicated, a misdemeanor.
Ossining village police said he was stopped at 2:10 a.m. Jan. 7 on Spring Street at the corner of Lafayette. A breathalizer test administered at the scene showed a blood alcohol level of .16.
He was released on his own recognizance for a future court date, police said.
