Ossining Man Accused of Sexually Assaulting Teen

Emar Mitchell of Ossining and Marvin W. Smith of Peekskill are charged with sexually assaulting a 15-year-old runaway.

Two local men are facing felony charges in connection with the sexual assault of a 15-year-old girl who had run away from home.

According to The Journal News, Emar Mitchell, 36, of Peekskill met the runaway at the Cortlandt Town Center on Feb. 26 and brought her to the Watergate Motel, where they engaged in sex, police said.

A man staying in a neighboring room, Marvin W. Smith, 52, of Ossining then engaged in a separate sexual activity with the girl, police said.

Although neither man used force, each was charged based on the fact that they are older than 21 and the victim less than 17, police said. Police did not say how the suspects knew each other.

Mitchell was charged with third-degree rape, a felony, and was sent to the Westchester County jail on $50,000 bail.
