Why the Journal News was Wrong About Publishing Gun Owner Information

The Journal News abused access to public data by aggregating and distributing it.

In the aftermath of the Journal News' recent publication of the identity of every handgun license in two counties, their claim that it would be good for starting a dialog on gun ownership is proving to be very wrong. There is discussion, not about guns, but about privacy and what constitutes responsible use of public information. On a personal level, I feel far more vulnerable as a non-gun owner than I did a week ago. It is now easier to find me and target my home and family.

The defense the Journal News offers hinges on the fact that the data was public. But what the editors do not distinguish is the difference between making information available and crossing the line and aggregating that information. The JN is not an almanac. They did not report news. They made it.

Here's why.

I am a real estate broker. I am also a member of the Multiple Listing Service and have access to that database. The MLS has records of every home in 5 counties via a direct link to public records. Just by knowing your name or address, I can typically tell you what you paid for your home, what mortgages have been recorded on it, and if there are other liens or judgements on the property. It is all in public records, but the non licensed person would only have access to that information by going to the county clerk or paying a website, which can be pricey.

If I were to exploit my access to this information and publish on my blog, for example, everyone in Westchester with a mechanics lien or mortgage default, the backlash would be justifiably significant. My job is to use that information to serve clients, not enrich myself by distributing it. Information can be abused. Access does not make it right to aggregate.

I'll repeat that: access to public data does not make it right to aggregate and mass distribute that information.

In a society where property records and property ownership are transparent, that access to public records is a public good. However, that doesn't mean that access gives me or anyone else the right to distribute that information to anyone who would not otherwise seek it through the regular channels. All that does is feed the least common denominator who neither went to the clerk's office nor paid a reputable source for it. The same goes for gun records. 

The cynical side of me makes me wonder if this was all just a ploy to be relevant. I haven't subscribed to the Journal News in years and stopped frequenting their website when they introduced the paywall. Now the publication is discussed coast to coast. Unfortunately, the discussion is not about gun ownership. It is about the paper's decision to distribute the data.

In an era where we all hope and pray that the 26 lost souls in Newtown did not die in vain, that is a very sad thing indeed. In light of their promise to publish the data on Putnam County, we should also remind them that their job is to report news, not be the news.

Just one last thing: I may not be in the database of handgun licensees (for now), but we do have a 95 pound German Shepherd.

This is pretty much always the case with the pro-gun group. Maybe that's why they feel a need to own guns?
What's really amazing to me is that the ACLU came out against organizing a database of mentally ill persons who should not own guns. That now puts them in the position of supporting the NRA. Talk about strange bedfellows. This Country had more than 10,000 gun homicides last year. How many dead people does it take before we inject some common sense into the system?

The argument has been framed as pro-gun, anti-gun; pro second amendment, anti-second amendment while the rest of us are really in the middle: common sense regulation of weapons and ammo capable of inflicting maximum fatalities in a minimum of time. Is that too much to ask in the face of the massacre of 20 children?

Great comments here. I’ll only add:
1) I’ve spent my entire professional career in the media and information industry. Have owned multiple TV stations, book publishing co’s and newspapers (regional and national). 2) I personally served as publisher for our multi-state regional newspaper chain when I had to fire bad management. We turned it around and I replaced myself. 3) Journal News mgmt here is relatively new and inexperienced. I knew the former publisher. He was good. 4) I made Gannett an offer for our fund to purchase entire Journal News Group a few years ago when it still owned its White Plains headquarters. 5) The offer, like everything else Gannett in Arlington VA does, was botched & dismissed. 6) This weekend, the Journal News put their 1st significant editorial commentary on this subject – BEHIND THEIR PAYWALL. This was laughable and contemptible. 7) The editorial says “We did it... to inform readers so they could make informed decisions about their safety and that of their family." http://m.lohud.com/?source=nletter-top5 … 8) Alternatively the editorial could read “We did it to inform and SHOW everyone – including criminals – where the hand guns are.” 9) And yes, that’s MY house on the Journal News map showing no hand guns on prem. 10) Gannett & Journal News, you are truly inexperienced, irresponsible, numskulls.

11) Don’t ever let your competitors do the first keystone interviews when your franchise is in jeopardy through mismanagement. Antidepressants (SSRI's) are known to cause suicidal and violent behavior and have been linked to many school shootings. See for example, http://ssristories.com/index.php?sort=date&p=school
Google "SSRI _______" (fill in the blank with the name of any of the recent shooters - Newtown, Aurora, etc). Read the articles linkng these shooters with their anti-depressants. The media does not cover this issue since the pharma manufacturers pay them huge advertising fees.

Not sure which I dislike more, hand guns or having home mapped as not having one. Watch what happens when O'Keefe's crew visits the homes of our local scribes and offers the folks who answer the door a yard sign saying "This Home is Proudly Gun Free."

Lisa - Maybe you should be an involeved parent and ASK the parents if there are weapons in the house. Maybe you should ask the journal news to print a map of people who own kitchen knives, medications, cleaning agents and other harmful things? Or maybe you can be an involved parent and get to know the people your kids hang out with. Typical lazy liberal parent.

Where does it stop? The Journal News and the liberals are all about NOT taking ownership. "Nobody told me" "I dont want to offend anyone and ASK if they have guns in their house before I send my kids over, etc."> So since they are ballless (yup) the cowards print it. Funny, now they all have guards at their homes and the headquarters. Wonder who is paying for that? Not everything public needs to be so. Hey Journal News, why cant we print the fact that almost all crimes are committed with guns that arew NOT registered? Or print the names and addressed of the convicted felons? Or who is on what "dangerous" medication? Maybe who owns butter knives???

Now let's see how consistent the outraged bloggers responding to this article are. Are you all equally outraged by the publishing of the salaries of teachers, police officers, and nurses? This information is readily available through the Freedom of Information Act, but rags like the JN publish it regularly in an attempt to stoke animosity and hatred toward civil servants. Does that bother anyone on here?
